These Terms of Service ("Terms") govern your access to and use of AnchorOne's website and services. By accessing or using our services, you agree to be bound by these Terms.
1. Services
AnchorOne provides Microsoft 365 governance services, including but not limited to:
- Baseline assessments of organizational Microsoft 365 environments
- Continuous governance and compliance monitoring
- Monthly governance reporting
- Incident response and security operations
- Backup and recovery services
2. The AnchorOne Standard
Our services are built on a fixed, non-negotiable standard. By engaging AnchorOne:
- You acknowledge that the standard cannot be modified, waived, or excepted for any reason
- You agree to bring your environment into compliance with the standard
- You understand that certain configurations (e.g., unmanaged devices, shared accounts, disabled MFA) are incompatible with the standard and must be remediated before or during onboarding
3. Assessment Services
3.1 Baseline Assessment
The baseline assessment ($2,500) is a standalone deliverable that:
- Documents the gap between your current state and the AnchorOne standard
- Identifies conflicts that must be resolved before entering the governed environment
- Provides a roadmap for migration
- Is fully credited toward onboarding if you proceed within 90 days of assessment delivery
3.2 Assessment Access
To conduct the assessment, you grant AnchorOne delegated administrative access (GDAP) to your Microsoft 365 tenant. This access is:
- Read-only for assessment purposes
- Time-limited and revocable
- Governed by the principles of least privilege
4. Governed Environment Services
4.1 Service Scope
Upon onboarding, AnchorOne will:
- Configure and enforce all controls defined in the AnchorOne standard
- Monitor your environment continuously via Microsoft telemetry
- Provide monthly governance reports documenting compliance state
- Respond to security incidents within defined SLAs
- Maintain daily backups with quarterly restore testing
4.2 Customer Responsibilities
You are responsible for:
- Maintaining valid Microsoft 365 licenses for all users
- Providing compliant hardware that meets the AnchorOne device standard
- Migrating or replacing incompatible systems before entry (e.g., QuickBooks Desktop requiring Basic Auth)
- Responding to governance findings documented in monthly reports
- Notifying AnchorOne of personnel changes, device procurement, or planned changes that may affect the environment
5. Fees and Payment
- Assessment fees are due upon engagement
- Governed environment fees are billed monthly in advance
- All fees are non-refundable unless otherwise specified in your service agreement
- Late payments may result in service suspension after 15 days
6. Data and Privacy
AnchorOne collects and processes telemetry data from your Microsoft 365 environment solely to provide governance services. This data is:
- Collected via authorized GDAP access
- Used only for service delivery, monitoring, and reporting
- Protected according to our Privacy Policy
- Retained for the duration of the service relationship and as required by law
7. Limitations of Liability
To the fullest extent permitted by law:
- AnchorOne's total liability for any claim arising from these Terms or our services shall not exceed the fees paid by you in the 12 months preceding the claim
- AnchorOne is not liable for indirect, incidental, consequential, or punitive damages
- AnchorOne is not responsible for failures caused by customer non-compliance with the standard, third-party services, or events outside our reasonable control
8. Warranties and Disclaimers
AnchorOne warrants that services will be performed in a professional manner consistent with industry standards. Except as expressly stated, services are provided "as is" without warranties of any kind, express or implied.
AnchorOne does not guarantee that the services will prevent all security incidents, data loss, or unauthorized access. The standard is designed to reduce risk, not eliminate it.
9. Termination
9.1 Termination by Customer
You may terminate services with 30 days' written notice. Upon termination:
- All administrative access is revoked
- Monitoring and governance services cease
- Monthly reports are discontinued
- You regain full control of your Microsoft 365 environment in its current state
9.2 Termination by AnchorOne
AnchorOne may terminate services if:
- You fail to cure a material breach within 15 days of notice
- You repeatedly request exceptions to non-negotiable controls
- Payment is more than 30 days overdue
10. Indemnification
You agree to indemnify and hold harmless AnchorOne from any claims arising from:
- Your use of the services in violation of these Terms
- Your violation of applicable laws or regulations
- Unauthorized access to your environment caused by your failure to maintain security controls
11. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Tampa, Florida.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email or through our monthly governance reports.
